Two things Once MS tells people that documents are signed ( particularly if it is in an email) , then "in-confidence" no longer applies and he is obliged to officially relaease.
It would be a very easy case for ASX to determine that the channel of "in confidence" (as detailed in section 3.1 of listing rules) is broken and the subject is no longer "confidential"
According to rule 3.1 Information ceases to be confidential if the information becomes known either selectively of generally and where the entity does not retain control of its use or disclosure. Well, Hotcopper knows that this "has been signed" MS himself will have been deemed to have broken confidence and the continuous disclosure rule.
The more likely reason MS does not need to release this info is because it is a Pensador arrangement not a CVI arrangement. Apparently Pensador has signed the deal.
