I think you are reading my mind! I think the courts are going to decide on that one, not me, a lowly Stock Forum Poster :-)
Regarding the class action, on the surface of it, and I am not a lawyer and also know very little about the details of the case, I would have to agree that any kind of refinance would mean that the debt is Current not Non-current. A saving grace may be in the definition of words. i.e. is a debt rollover a refinance? If it isn't then the debt was probably rightly classified as non-current.
