There is no doubt that the disclosure should have been to that effect fatboy, but more importantly, if you were an unsophisticated investor, you should not have been allowed to make the invesment into OP as the product did not have a full PDS approved by ASIC.
Most companies that target sophisticated clients must have a letter from their accountant stating that they meet the requirements of sophisticated or qualify under the corps act.
Bottomline is that many OP clients should never been allowed to make the investment in the product as they were considered retails clients not wholesale or sophisticated.
These laws were brought in to protect retail clients against poor disclosure. Seems like many were really let down with OP
