TC - I am sure they would have their suspicions but I dont think he has enough to lodge a sub holder notice as yet - but even if he did I dont think there is diddly they could do about it.
The ducks guts of it is that they couldnt make loan repayments in cash so they issued him stock instead of cash.
He would say simply that he is converting that stock to cash recoup some of his capital. Therefore, while I and others may hypothisise as to his motives and what his intentions are - the argument would be as simply as - they issued me stock instead of cash and I am turning it into cash.
Therefore as I see it, the only action that can be taken is for the company to make arrangements that allow him to be paid in cash rather than kind and do that asap -
I dont know if there is a capcity for them to pay cash at next due date but if his mo has been to push the price down so he gets a larger line of stock then I would be so chuffed to see that the capping was all for nothing
