No, CFE had in their announcement that they will provide 3rd party access which of course means London will be able to use it.
Seems to me the logical thing to do would be to split the cost of refurbishment by 2.
If London lose, you have got feel for them, they and the mines department botched their paperwork. Clearly the intent was there to cover this disputred area but the execution was not.
I would imagine that they are spewing over the potential loss of 50Mt of tailings if it goes against them. And the potential of not securing full control of the railway.
If a external lawyer did London's paperwork I would suggest a big PI claim could be coming their way.
