Ady would have fallen anyway due to world circumstances
Lin, you are right he would have had to claim as capital loss 2008, however until mediation went though he would not know the extent of the loss ....eg dividend on Liquidation.
If ANZ give back his share holdinds in which legally is highly unlikely,(as they are addmitting wrongful sale of share holding).

PT intended to take his shares out of his holding account a week or so before the collapse. Before the collapes the sp was a lot lot higher so he might have sold some, who knows?This is why I believe he will have a cash settlement out of court because he WAS lucky to have had his holdings legally in transition back to a nominated account.
