I have read it and it does not accuse anyone of anything. How have they prosecuted without making an allegation?

It has factual information in it and a set of questions, presumably for their insto client to ask management of ISX.

What do you rely on to say OM released the report into the public domain?

Sounds like you are making accusations against OM without having even read the report or knowing how it found it's way into the public domain.
