The point is that SO4 is being formally assessed, as they should be, and by their own admission are still working on their ERD which will take them to stage 3 with the EPA.
I don't think they will have any problems but it seems clear from this quarterly that the second round of debt funding is not available until certain CP's are met and I suspect that includes EPA formal approval. This is why the latest cap raise took place. It's good they can raise cash but you can't count on the EPA doing SO4 any favours to avoid another cap raise.
If you don't mind dilution it doesn't matter too much.
As for RWD, they will have WA EPA approval before SO4. Take a look at the EPA timeline for KLL after they lodged their ERD to get an indication of how the wheels turn. The EPA follows a defined process.
