There is no "third party" per se.
I asked the question of the company a little while back and was assured that the use of the term "third party" was common although they are in negotiation with only one (other) party.
I guess it is a matter of where you went to school or the usage in different countries. Personally I found the use of the term "third party" misleading but I do not think it is any great deal. Probably makes me a minor pedant !
