If you are referring to the various legal proceedings, I doubt that institutional investors have a much better read as they will have to rely on what the company is telling them. Without having seen the underlying documentation (which the company will not be able to share) and having legal help in reviewing it, it's pretty hard to form an opinion I think.

The other point I would make is that I am not sure how much certainty management itself has. There is the saying that on the high sea and in a court of law you are in God's hand. In respect to the courts I find that quite accurate.

Lastly the quality of the institutional investors on the register is not great, maybe with the exception of Thorney, but so far their read of the situation has not been very good.

So I think you are right. It is a gamble; one where you have no real way of knowing the odds.
