It is very likely that Decmil will have to pay $11m to SCEE. The adjudication is just a middle step and the arbitration is likely to be a protracted process whereby if Decmil loses, they will have to pay the $11m plus any legal costs incurred and lawyers aren’t cheap. Decmil’s track record seems to suggest there wasn’t appropriate governance and controls within the organisation which led to significant contract mismanagement.

just goes to show they are on thin ice and the Sunraysia or SCEE Payment could lead to solvency issues.
