I think that refers specifically to earnings guidance, rather than general market sensitive news. Market sensitive news and thresholds for disclosures are applied thus according to the ASX:
So it looks to me like ASX are in breach of their rules, only if the news that they didn't announce moved their shares by more than 5%. It hasn't, so they're looking alright to me so far.
