The ASX Short Sell list has actually been the ASX's approved naked shortsell list with the criteria being sufficient volume and depth. You could sell those stocks without holding any scrip.
I can still quite legally short sell any stock on the ASX simply by reaching agreement with a significant shareholder who is unwilling or unable to sell any time soon, to borrow his stock for a fee, and then sell the stock in my own trading name.
