I disagree. whilst such clauses make it a lot cleaner to determine the penalty amount, at the end of the day a contract relies on delivering what you say you will within a defined period. Altura believe the delays were "attributable" to civmec and civmec believe the reverse.
although I think we can agree greedy lawyers are the only winners.
