If the company can prove that they did nothing wrong, then it shouldn't cost them anything (claimant should pay costs). If they did do something wrong, then why shouldn't they pay.

I have not joined the class action yet, but if I can recover some of my losses that were incurred because I was not fully aware of the companies financial position before I invested, then why wouldn't I (or any one else in the same position).

It's like being given a "get out of jail free" card.
