@ChillingOut, your inquiry is relevant and that is part of ISX's problem. ISX has stated that ASX is conflating a) ASX's right to ask questions and receive answers with regard to regulating compliance with the listing rules with b) asking questions which have more to do with ASX's defence in the court case.

And I would think that every time ASX oversteps the line between exercising its rights as a licensee and ASX the defendant, it would provide further evidence for ISX towards not being treated fairly, honestly, in good faith, and/or providing procedural fairness.
