While I'm not sure about these sort of devices, I do know diagnostic tests can be sold prior to regulatory approval. The lab just has to do their own validation procedure prior to use. The announcement on Ventitest says 'approval for sale..', which implies it can't be sold yet but I would have thought diagnostic tests would be subject to a higher bar than this sort of device.
