I don't think so. You can always argue that the dominant purpose of selling is to generate enough cash to participate in the SPP. If by doing so creates a loss for the shares sold then it is only a result of the "dominant purpose", nothing else.
This is only my opinion, you should always seek professional advice when it comes to tax.
