I made contact with A-S-I-C a while ago, and as part of their response (not the full context as I dont want to be recognised by them) and it may be a 'generic response', they said:

I understand that ISX has commenced legal proceedings against ASX in the Federal Court and with that in mind, it would be inappropriate for ASIC to make any statements while the proceedings are ongoing. While I cannot comment on all matters pertaining to this issue please be assured we are closely monitoring developments in these matters to ensure that all relevant parties are complying with their respective legal obligations.

I took them to task for not protecting shareholders from ASX not following their own protocols for dealing with or declaring "conflict of interest" with ISX. I also asked as to whether ASX had declared that a conflict of interest had been received by A-S-I-C? No answer on that one.

I believe there is much more to this story. If anyone else has been in contact with A-S-I-C, I would be very interested to know the crux of the response you received.
