I'm no lawyer, but from what I read I think you will find that if you sell on market there should be no problem. The difficulty here. as we all know, is the scarcity of buyers.
However, if you sell off market and you know that the buyer has no intention (or ability) to meet the obligations you may well find you do have a problem. Your position may be further weekened if it can be proven that you paid the buyer a fee, (and wouldnt you have to, otherwise why would the buyer want to be involved). You may possibly find that "conspiring to defraud" charges may be thrown in for good measure.
I reiterate, I'm no lawyer. Anyone thinking of such a scam should pay one for advice.
