Why hold a BD to promote an unproven tech that is 3 years away and clearly ignores your chief scientist Prof Dahn. Go figure . Re the patent, my staffy knows silicone has a high capacity so it would be very hard to patent as you say, and if they can find a glue then presumably it could be copied or slightly modified to circumvent any patent. Elon is taking a long odds punt IMO. It seems to work for him but that’s no guarantee and if I was a Tesla SH I would be nervous and I have 50 billion reasons to support that view.
