That's actually false, they have filed a provisional patent;

Provisional basically means they get 12 months to decide whether or not to proceed with a full patent (expires Jan next year I believe).
And two agencies signed up to 24 month contracts post trial, I spoke briefly with one who gave positive feedback.

The SP action is pretty poor, relatively low $ traded sub 8/9, could be a long wait until the next update Fxm may get his shares at 5. At sub 5 mil MC with the potential upside and limited down side this is a buy for the patient IMO.
