That makes perfect sense. Your bargaining position is always the strongest when it's clear you have a fall back position and that you are prepared to take it and walk away.
The FDA's bargaining position, by comparison, is very poor because they don't have a fallback position for the unmet needs of kids with aGvHD.
And I also think we shouldn't underestimate the willingness of the MSB Praetorian Guard, being the parents and organisations who have a life and death interest in having access to this medicine, to legally challenge the FDA's ultimate decision.
That determination of that Praetorian Guard falls away if they have access to that medicine via compassionate or other means. But if they have to pay full fees because insurance won't cover treatment that is not FDA approved, watch them come roaring over them hills!
