But, - I emphasise this point - strategic thinkers (this does not exclude lawyers who take instructions from their clients but also collaborate on strategy) do not go the litigation route as the first step. These days it's mandated anyway but I digress.

Good strategists (this does not exclude lawyers, remember?) cover themselves but they will try negotiation and every possible avenue before going in with guns blazing. There is also the look of the thing. Or the optics as we say nowadays.
