Legally, The banks & directors have done nothing wrong.

Morally, however they have just shown that they have no heart nor social concern or value for fairness.

a common sense court of law would make ruling base on a combination of both legal & moral matters, in the end i think the noteholders stand to win on moral ground and that's 1/2 our battle won. The law should right these wrong so scums like these bankers & directors don't take advantage of the muddy situation otherwise no-one will have faith anymore in the financial system.
