If you wanted to form a class action you gather the evidence first and do the analysis to see if there is any grounds. You don't determine you are launching a class action and then go hunting.

If I was personally going to go down the CL pathway the first thing I would want to do is get my hands on the most recent financial report which as of this moment in time is overdue but some margin. The fact it hasn't seen the light of day suggests the blame may rest with the old executive. The fact that PLS got an inside look and then pursued the current course of action is another huge clue regarding who is responsible for the current situation.
