See thing is Trump's legal team have fronted up in the lower court and the cases have been throw out because there is no evidence, if they had evidence why would you not provide it. Now if you get to the supreme court without evidence it will get thrown out too

Evidence wasn't heard in these district courts. Irrelevant. Moving on and up to Supreme. The constitution still matters and overides partisan lower judges.
