I think there is little room for such moves by the DEFF now because they still need to show some legitimacy and efficiency in case of future scrutiny by other parties/courts.
they must issue some ruling and that ruling must be aligned with the information they received from DMR and the company. Also the fact that experts’ panel wasn’t engaged would be considered. In other words, their ruling can’t be a total illogical surprise that will not stand anywhere further down the road.
