G'day, have you read the judgment and, if so, are you able to highlight any passages that were 'confused and contradictory' and why Mr Aston was correct? Damages were awarded according to well-established principles associated with the awarding of general and aggravated damages. That was spelt out very clearly commencing at para 228 and continuing. There was nothing novel in the approach taken by the trial Judge based on the evidence adduced. I'm not sure if a Notice of Appeal has been filed though the time for doing so as passed and no doubt the Respondents would have been fully advised on the prospects if they wished to pursue an appeal.
