I may be misreading, but just the way you called it a 'rule' I thought I'd point out you can decide which shares it is you want to sell: https://www.ato.gov.au/general/capital-gains-tax/shares,-units-and-similar-investments/identifying-when-shares-or-units-are-acquired/
You can do first in first out, but you're not required to do that.
