Today was just a procedural dispute about what documents ISX has to disclose to ASX in the "discovery" phase of the long, long process towards the big court case. It was all over pretty quickly and I was late starting so this is just my take of today's proceedings.

Without being able to see the briefs, it seems that ASX want everything, including communications between ISX and other parties.

In my opinion, it seemed the Judge agreed with ISX's view that they provide source documents but not necessary communication with 'experts', and not necessarily in categories that would disclose what source documents ISX provided to other parties.

The judge also reiterated that if there are any further disputes about what documents the 2 parties have to give each other, come back to court to sort it out.

This is part and parcel of our long-winded legal system, and I wouldn't be surprised to see ASX dispute other things... it usually delays the whole process, and perhaps that is more important to them than whether these little battles are won or lost?
