By the way last week I rang the ASX (Sydney office) and asked them about the appropriateness of using the average SP of the prior 12 months in valuing their proposed free shares.

The ASX said it was not an issue in respect of the listing rules and referred me onto someone at ASIC. I have raised it with ASIC and they reverted back via email and told me that they had passed on my complaint to the relevant people to look at.

IMO they will most likely have to issue a supplementary EGM notice using the correct 'spot price' to value the options. This will at least make it clear for all shareholders to make an informed decision on whether to vote for or against the free shares.
