From my recollection it is a civil case where a fine (if applicable) would be the most common penalty to apply
As for JK ,if found guilty and ASICs recommendation for him to be removed from directorship is approved by the court ..... it doesn't have a direct impact on the PS as there is NO indication ( and if there is please provide the relevant commentary) that the PS were obtained ILLEGALLY as such how can the court remove the PS ?
So I refer back to my previous comment, if the penalties (if any )set by the court have no direct bearing on the PS why isn't ASIC requesting ASX to lift the suspension?
I do welcome the thoughts of those with much much more legal knowledge.
