The Land Court hearing is not scheduled till Nov 2021. Based on the previous hearing , a time frame of say 12 months is not out of the question. The opponents to granting a mining licence (OCAA) are confident that their opposition will this time be successful. After all they have a favourable ruling from the HCA. If New Acland were to be granted a licence, I would expect OCAA to appeal , appeal and appeal again through the Queensland Legal System and if necessary back to the HCA. As contributors might recall, the HCA determined that the mere fact of a litigant like OCAA being bereft of money , insolvent, does not prevent them bringing an action in the jurisdiction of the HCA. The HCA case was a bonanza for the legal team at OCAA. New Ackland paying their fees and past awards of costs against OCAA set aside. The New Ackland legal imbroglio is a legal money sinkhole for New Ackland's legal team . Whereas at OCAA , they have pro-bono lawyers enjoying the public support in cities and media organisations like the ABC, Fairfax Media.
