I think it depends on the regulatory regime. I was invested in a company in Alaska which was being accused of drawing gas from an adjoining lease and facing compensation claims from the adjoining leaseholder for the value of gas it reckoned was being extracted from its lease. The court was taking the claim seriously. I guess the adjoining lease holder would have to collect a fair bit of data on the depressurisation profile across the reservoir that lies under its lease to substantiate its claim though.
