Yes there is nothing wrong with what you have done in contacting ASIC.
Without any experience of placements, I would imagine a company would scout the insto market to see the level of interest and an indicative price. I presume this is quite legal and common but it does leave the way open for 'leaks" as you say.
I agree there are dodgy practices but I am not sure ASIC knows how to fix them.
