No, that's not quite correct about the US market.
The American regulations would require FDA approval to market infant formula for consumption by babies under 12 months (and the approval is quite a protracted and difficult process). It is also the specific product rather than the facility that is subject to the approval.
However, to my knowledge they would be able to export, market and sell Stages 3 and 4 in USA without any obstacle (which is what BUB has done recently). There is actually nothing stopping them on that front.
