While the current MMX board publicly outcry that the CHM (and EvansKoh)case(s) have no merits, they settle the small claim with a multi million dollar settlement.
The upside for CHM is that if they do get anything from $50 to $500m, any amount is upside for CHM.
MMX will live through this problem and more likely be taken over by Sino when all this concludes.
