I will be your contrarian on this - the company has sought to undertake a transaction that it has a view on and the regulator would appear has a different view on. So where there is an impasse what to be done? Does the company take a second opinion (hopefully yes) and test it’s positioning on the law and if there is doubt then look at reasonableness of the company position biz the deal and impact on the company. At some point the company has to either litigate if it is insistent it is right or capitulate the deal or find some middling ground. So respectfully from my view I think with these things it’s always with the company in some way, shape or form whether we like it or not. But this is just my view.
