hi all... i just called the ATO and spoke to a very helpful consultant.

originally she said that if the Trust had advised you "officially" in 08/09 of your distribution, then tax is payable in 08/09.

I received no such notification, as indicated by the letter i just received yesterday from CRT.

However, she then asked a "specialist", who said regardless, if a notification had been received or the Trust had failed to do so, the tax is payable in 08/09.

Seeing as how this seem to be a little "grey", she asked if i would like a senior specialist to research the tax law and advise.

What the hell - i said yes. I'll let you all know when i get a call back.
