2 things.
Firstly, ESI has stated in announcements that they will try to access brown coal from existing mines (eg Loy Yang). We know for a fact that LY's brown coal has no restrictions which means that it can be legally exported.
Secondly, Exergen have nothing in the bag at the moment. In order for the government to release new reserves, each applicant will be required to apply via a tendering process which will be subject to a due diligence process conducted by the government. ESI has as much of a chance to access new reserves - assuming they will bother to apply.
