Lets just play along with your silly argument and say by chance the JV technical obligations currently have not been met and we are currently sitting at 2.5 years or there abouts out of the 5 years, MCT still have ample wiggle room to rectify any said non completed compliance. Its probably a good thing that NME has raised what ever it believes it can throw at the takeover panels (and get thrown out) ,raise whatever it likes with ASIC (and that too probably will get thrown out based on the lack of and utter made up supplied evidence to the TO panels), as it actually benefits MCT with time to meet the said outstanding obligations as per the JV within the 5 year time limit. If you also have read the Takeovers panels reasons for decisions evidently they too have clearly determined in MCT favor (Note evidence provided by MCT, NME and ASIC in determining these decisions) and raised alarm bells on NME management. MCT still and has the upper hand IMO and I believe most NME shareholders would come to the same conclusion. MCT nudging 30% shareholding in NME is significant and I wouldnt be surprised their last civil claim when thrown out will see the Cow digested completely by the Python as one poster has alluded too GLTAH
