Hi vivRookie. Sounds like you've sighted the contract? 'One of the implied terms she is relying on is that the company will make best efforts to maximize the profits she'll get for her shares.'

I would've thought the contract would more likely be along the lines of needing to make 'reasonable efforts' to progress the technology by certain dates. If there is evidence that little or no effort was put in before those dates were reached then maybe they could be in breach? Up to the courts to interpret 'reasonable efforts' based on the evidence.

All speculation as I don't believe the contract details are known to us, and most likely never will be. Unknowns are not good for the sharemarket and until the matter is resolved it will continue to be a drag on the share price.
