Just a few observations:-
In Au Xingao's 4th Supplementary Bidder's Statement dated 4 April 2022, "2...(b) as at the date of this notice, the Bidder and its associates have an aggregate voting power in Bullseye of 15.30%, comprising 68,172,693 of the 445,599,851 ordinary Bullseye shares on issue."
Ignoring the unanswered FIRB issue and the Blue Cap Loan issue (both noted in the 4th Supp. Bidder's Statement), it is amusing/strange to see this in the Target's Statement."One of your Directors, Dariena Mullan, recommends that you accept the Xingao Offer...Further, Notwithstanding her recommendation of the Xingao Offer, Bullseye Shareholders should note that Ms Mullan has previously accepted the Emerald Offer in respect of all Bullseye Shares owned or controlled by her and that Emerald will continue to have a relevant interest in those Bullseye Shares (given that Emerald’s Offer is unconditional and that no withdrawal rights apply in relation to the Emerald Offer)." The reference to the lack of withdrawal rights relates to the directors shares.
Having read the 18 March 2022 Target's Statement, why you'd sell your Bulls Eye shares to Au Xingao is beyond my comprehension! Even at today's EMR closing price, the EMR offer is above the 35c Xingao offer. ($1.23/3.43=.3586)
If one can work out the future plans of Xingao to commercialise Bulls Eye's tenements, let us know!
Also, EMR will pay you within days. According to the 18 March 2022 Target's Statement, "Subject to the terms of the Xingao Offer and the Corporations Act, you will be issued your Xingao Offer consideration within one month after the later of
i) the date of your acceptance; or(ii) the date of that the Xingao Offer becomes unconditional.In any event, assuming the Conditions are satisfied or waived, you will be sent payment within21 calendar days after the end of the Offer Period."
In relation to Matter COR 83 of 2020 – Supreme Court of Western Australia "The proceedings are continuing on a block of dates running from 22 February 2022 until 11 April 2022, and then a further block of dates to run from 1 August 2022 until 26 August 2022.In total, the matter has been listed for a trial length of 66 days."
Matter CIV 1989 of 2020 – District Court of Western Australia "The trial of the action commenced on 31 January 2022 and proceeded for four sitting days.On 4 February 2022, the trial was adjourned part-heard until Monday, 17 October 2022 for an anticipated further four days."
