The current court case is all on the open cut anyway they haven't legally been able to submit the underground proposal into the council - this is what the statement means and is not new info we have known this for several months now. I think regardless of the initial outcome this will move to the supreme court as whoever loses will file an appeal. To which I believe could give INF an opportunity to present the new underground project but they may still need to have it resolved at the supreme court level prior to submitting the underground project which would bring more delays. Regardless the current court case is still centred around the open cut proposal and INF disputing the removal of the PIV.
