249D Submitted - Why Not Announced?, page-14

My understanding is Mr Boysen and another shareholder who is USA based submitted their 203 and subsequent 249D forms legally about a month ago.

The Board sought legal advice and chose to claim the documentation was not legal as the USA based investor holds his shares in a Nominee account and thus was not a valid requisitioning shareholder. Keep in mind this shareholder will be legally able to vote the current board out at the general meeting yet to be called using the same nominee account.

The current board were not being cooperative with the said wishes of the current shareholders and instead it seems were more concerned in ignoring their wishes for change.....IMO

It seems Mr Boysen has then joined forces with another local shareholder approx 3-4 weeks later to resubmit another 203 followed by 249D form which has subsequently been announced to the market.
