Reading between the lines, he says “The Joint Authority has made a recommendation to NOPTA; the court process will determine and expand on and provide details on exactly what occurred." So it sounds like a fishing expedition. Just take it to court and cross your fingers and hope you find something.

The bottom line is, how do you proceed even after a successful Federal Appeal? It sounds like a successful Federal Appeal will make the first application's decision null and void, and then it would either need to be reconsidered or the second application would be considered. Either way, it would come down to the Labor party, and I just don't see them approving it.

To be very clear, I still believe their Federal Court appeal will fail, I believe the law was followed, and I believe the Act does allow a delegate to have full authority for making decisions on NOPTA applications.
