I asked the board if there was a break fee in either direction –but didn’t get an answer. However, break fees are nearly always disclosed, as they put pressure on all concerned. There is no reference to a break fee anywhere in the E Booklet, so I’d be fairly confident that there wasn’t one. In any case, as you say, the other sunk costs of this failure are huge anyway, not to mention the distraction of senior personnel from running the business.
