Evidence is pretty overwhelming. Not like you can go back in time and reproduce submitted avadavits and erase IP logs and recreate a timestamped paper trail. Having said that Allen does not deny he submitted online votes on behalf of various shareholders. In his advadavit this confirms it and the issue here is in his sworn avadavit submitted Allen claims he has those powers to submit shareholder votes based on discussions with various people and based on these discussions with various people does not give authority to act on shareholders behalf IMO. As I understand a completed and signed proxy form assigning Allen as proxy by the shareholder must be submitted by the due date to be valid and giving authorised power to Allen to vote on behalf of shareholders. In Allens advadavit these forms were not received by the shareholders and he relied on just communications and converstations, some of which were not even the shareholders themselves. Pretty hard to dig yourself out of this hole IMO
