As Advent1969 said, "So, back to the three choices.....
Walk away and pay $6m, or stump up $2.6m for costs and tie up another $10m or so for 5 years, or a third way?"
What your saying Chilly, is option 2 in Advent 1969's post, stump up the money now, its not the third way.
I think the third way is to make sure the ASIC v ISX case is run before the ISX v ASX case. So by delaying payment at this stage, this will get the desired result. The ISX team obviously believe a positive result for ISX from the ASIC v ISX case will put the final nail in ASX's coffin without ISX having to tie up millions of $'s at this point in time. I believe the ISX management do not want to walk away, they want to get justice and compensation for what has happened, but they want to achieve this without locking up millions of $'s. As I said in my earlier post, from the desperation and ranting from anti ISX'ers, this third option is not what the want.
